Comments and other content submitted to any anti-spam service are not saved on our servers unless they were marked as false positives, in which case we store them long enough to use them to improve the service to avoid future false positives.

By uploading and submitting graphics for any custom Whirly Board products, you agree to the terms and conditions that hereby grants Whirly Board the right to use the Licensed Property for custom board creation and understand that you have the legal right to use and distribute the artwork provided.
1. License
1.1 Grant of Rights. Purchaser hereby grants to Whirlyboard the right to use the Licensed Property for the Purpose. Purpose shall mean the use of the Licensed Property on the Whirlyboard product.
1.2 Licensed Property means any trademarks, copyrights, or other intellectual property (“IP”) provided by Purchaser to Whirlyboard.
2. Purchaser’s Representations and Warranties. Purchaser represents and warrants that:
(a)it is the sole and exclusive legal and beneficial owner of the entire right, title, and interest in and to the Licensed Property;
(b)it is the record owner of any related registrations and applications, and all such issued registrations relating to the Licensed Property;
(d) the exercise by Whirlyboard of the rights and license granted under this Agreement will not infringe or otherwise conflict with the rights of any other person or company; and
(e)there is no settled, pending, or threatened litigation, opposition, or other claim or proceeding challenging the validity, enforceability, ownership, registration, or use of any Licensed Mark.
3. Indemnification
3.1 By Customer. Customer shall indemnify, defend, and hold harmless Whirlyboard and its affiliates, officers, directors, employees, agents, sub-licensees, successors, and assigns (each, a “Whirlyboard Indemnified Party”) from and against all losses arising out of or in connection with any third-party claim, suit, action, or proceeding (“Third-Party Claim”) relating to any actual or alleged: (a) breach by Customer of any representation, warranty, covenant, or obligation under this Agreement, or (b) infringement, dilution, or other violation of any intellectual property or other personal or proprietary rights of any Person resulting from the use of the Licensed Property by Whirlyboard or any Whirlyboard indemnified party in accordance with this Agreement.
